This master’s thesis aims to analyze the major problem of HIV-positive workers’ discrimination and to reflect on the impact that being infected may have on fundamental rights, in particular on the right to privacy. For this purpose, we will study how and to what extent the International, European and National legal framework protect HIV infected workers against discriminatory practices and analyze whether the infection can be considered as a disability under Directive 2000/78. Finally, we will focus our attention on the HIV-positive surgeon and discuss if and under what conditions he/she is able to continue medical practice.
