Abstract

This thesis aims to analyze a latent problem in the international political scene. It concernsthe viability of a harmonious coexistence of the practice of the Islamic Faith with theconcept of a modern State, namely, democratic, and liberal, based on a legal frameworkof Fundamental Rights of a universal nature.Therefore, it follows the thought of an American Sudanese Muslim, Abdullahi An-An'imregarding the compatibility of the orthodox content of the Islamic religion, with respectfor Human rights. On this basis, An-Na'im also analyzes the characteristics of a modern secular State, as well as the viability of authentic Muslim experience within its scope, the equality between citizens and its respect for Human Rights. Although with an orthodox religious justification, An-Na’im's argument is, eminently,legal, and political, developing, and articulating concepts capable of providing a positive answer to the initially raised question.
