Abstract

This paper is based on the changes introduced by Decree-Law No. 10/2023 of 11 February to the tacit approval procedure and also to the prior communication procedure with a legal deadline. In particular, we will analyse the new certification of these provisions, their legal framework, and the practical consequences for the administrative procedure. The aim of this work is to provide a legal overview of the amendments to the Code of Administrative Procedure and Decree-Law No. 135/99 of 22 April, highlighting the differences with the previous legal framework and critically evaluating the merits of these amendments.
