Abstract

This dissertation envisions the reform of the forced heirship provided for in the Portuguese Civil Code, starting from its origins and the principles that govern it, proceeding also to a critical analysis of the trends of changes in European legal systems in this matter. As elements for the consideration of replacement or modification’s hypotheses of the current system of compulsory portion, the potentialities of the Family provisions, foreseen in the Inheritance (Provision for Family and Dependents) Act 1975 (UK), were taken into account, as well as the use of other parassuccessory protection techniques.
