Abstract

In the present study, we propose to analyze the relevance, from a labour standpoint, of the relationships entered between digital platforms and those who render their activity therein. To this end, it is essential to identify the different elements that form the object of the present work, such as the historical, social and cultural context that led to the onset of the so-called“Platform Economy”, but also to understand what a digital platform actually is and the main differences between the organizational models adopted there
of. Regarding the providers, a “case by case” approach is emphasized in the analysis of their status vis-à-vis platforms, which necessarily takes into consideration new manifestations of legal subordination, inherent to the use of the power of direction and control by the platform, but also by the individual degree of organizational dependence revealed by the provider. Finally, we end by highlighting the important role of the European Commission in harmonizing this issue across the Member States, but also the role of the Portuguese legislator in regulating the labour market with a focus on promoting decent work, with special impact in the context of the “Platform Economy”.
