The contractual assessment of the employee inability to perform his professionalobligations, due to the circumstance of him being arrested, whether it is in preventive detention or effective imprisonment due to conviction, is a complex subject. This study focuses on exposing the barriers to the solution of the problem and for this purpose an analysis of our superior courts decisions and doctrine is essential. With this dissertation we aim to show case what are the solutions that we find relevant to achieve the most adequate outcome, taking into account the positions of both the employer and employee.
