Abstract

This Dissertation seeks to establish a discussion on the pertinent theme of promoting human dignity for women prisoners, given the global scenario of recent years of increased incarceration of women. To do so, we will have to understand the concept of dignity and how this principle can act to guarantee the human and fundamental rights of women, analyzing which international standards provide these rights in a clearer and more objective way, targeting the specific needs of women in the prison environment. The prison system was initially created only to receive the male public and therefore, throughout history, needed to be the subject of discussion by the United Nations about its suitability for women, both in relation to the way in which States can provide assistance to them, as in relation to the necessary changes in prison structures. Furthermore, it will be analyzed whether Brazil, one of the countries with the largest female prison population in the world, has adopted the measures recommended by the UN in its internal legislation and how it guarantees respect for the human dignity of women, in comparison to Portugal, a country located in Western Europe, inserted in a different historical context and with a smaller prison contingent in view of the reality of South America. At the end, the difficulties encountered in the analyzes carried out will be exposed, as well as which measures were adopted by the countries and if it demonstrate to be effective in the promotion of human dignity on the female prison reality.
