Supported by an analysis of international legal doctrine and jurisprudence, this work intends to demonstrate the complexity, similarities and differences between European Union and US law with regard to the persecution and criminalization of LGBTQIA people in the country of origin as a requirement for granting refugee status. In this complex environment, a multidisciplinary approach is required, based on ethical principles and educational measures, and it is important to place the person who belongs to the specific group, LGBTQIA, at the center of the issue, ensuring protection.
