The vertical relationships between buyers and sellers in the agricultural and food industry is characterized by an imbalance in bargaining power between them. In an attempt to protect producers and small & medium businesses against unfair commercial practices by suppliers and retailers, the European legislator created the Directive 2019/633. This dissertation consists of the analysis of this embryonic legislation, comparing it with the Portuguese legal regime and, in particular, with the competition law regime. The aim is to understand the existing efforts to regulate the negotiation power imbalance between the parties of the food supply chain.
