Responsabilidade civil das concessionários por acidentes de viação ocorridos em autoestrada

Abstract

This paper deals with the nature of civil liability of road concession companies fordamages suffered by users of such roads.The various opinions expressed by doctrine and by the Portuguese courts in the last decades are carefully analyzed. The doctrine and the courts have based such liability either in tort or in contract. This issue is extremely relevant, taking into account that solutions may vary according to which way is chosen.We describe and criticize the opinions from different authors that have already statedtheir position on this matter so that, by the end of this study, proper conclusions can be sortedAlso Law n° 24/2007, from 18th July, more specifically the article 12.° are subject to analysis. However, as one will understand throughout this study, the law maker didn't answer to all questions about this topic, specifically about the main issue of this dissertation: the nature of civil liability road concession companies for damages suffered by users of suchroads.
