Following the adoption of Directive (EU) 2024/1069 of the European Parliament and of the Council of 11 April, the main objective of this dissertation is to frame and explain the phenomenon of SLAPPs (Strategic Lawsuits Against Public Participation). The first part of this dissertation will be dedicated to the clarification of concepts and the historical and cultural framework of SLAPPs. This will be followed by a comparative law analysis of the impact of SLAPPs in other legal systems, along with an examination of Recommendation CM/Rec(2024)2 and Directive (EU) 2024/1069 of the European Parliament and of the Council of 11 April. This study will also focus on the relevant national legal provisions on the subject, as well as on the predominant legal scholarship concerning freedom of expression.
