The inhibition of parental responsibilities is a form of State intervention in the family sphere that necessarily takes place when parents violate severely and irreversibly the contents of parental responsibilities. This State intervention aims to ensure the child’s best interest over the parent’s rights. This paper is based on the advocacy of child’s rights and aims to enhance the gap between Family Law and Criminal Law as to the possibility of withdrawal of the inhibition of exercise of parental responsibilities, once the ground to the inhibition has disappeared. It will be said that, in the accurate terms proposed by Criminal Law, the inhibition of parental responsibilities, as an additional penalty, doesn’t ensure an effective guardianship of child’s best interests.
