Both the Portuguese Constitution and the Civil Code specify very precisely the parents’ duties towards their minor children however, the same detail is not verified regarding upward intergenerational solidarity. The present project approaches some of the problems which arise in the Portuguese society in the context of fulfilment of duty in the care of children towards their parents searching for fair solutions. Besides the doubts about the context of the “maintenance” concept when parents are in a situation of vulnerability, due to illness or age, are problematic the issues of the requirement in that parents bring legal action against their children who don’t abide by their duties of assistance they are obliged to carry out, the question of reimbursement to their caregiver son, that is, the situation where there is a plurality of children obliged to maintain, but only one of them fulfils his/her obligation towards his/her parents.
