The investigation concerning the judicial decision-making process on parental neglect is still very scarce when we look at the national context. The main aim of this study is to contribute to a better understanding of the judicial decision-making in situations of parental neglect, from the perspective of judges. Under a methodological board of a qualitative and explorative nature, we used the interview technique to access to the perspective of the judiciary magistrates and the analyses of their speech on the theme of this study. The main results suggest that the individual children’s characteristics are the most valued aspect of a judicial decision. However, the characteristics and parental skills are also seen as key elements to the decision. It was also observed that life experience, beliefs and the magistrate’s personality seem to be important components to the court decision.
