In the current economic and social situation, Insolvency Law is playing an increasingly important role, especially in its restructuring aspect, hence the interestaroused in choosing this topic.The outbreak of Covid-19 has caused a "total" crisis, with serious consequences for the universe of companies and the economy. Nowadays, a company can easily be faced with a lack of liquidity, without ceasing to be viable and useful to the economic tissue. One of the goals of this Directive is precisely to save viable businesses of honest entrepreneurs, namely through the cross-class/cram-down mechanism. Thus, the interest and opportunity in its transposition should be unquestionable. Thus, in this dissertation we intended to conduct an in-depth analysis of the consequences that the adoption of the Directive on preventive restructuring may have on the Portuguese legal regime of PER.
