The weak competitiveness of the Portuguese economic climate leads us to question its ways, trends and current solutions for companies to achieve a solid position in the market. The means of financing used by most Portuguese companies are still very archaic, and most of the time they find their support in banks. With this dissertation we aim to highlight and draw attention to the importance that venture capital/private equity can play in the Portuguese economy. This type of investment is largely responsible for the emergence and development of new technologies and services. As far as Portuguese legislation is concerned, the Asset Management Regime was recently approved and will be one of the central themes. In addition to analyzing this new Asset Management Regime, we will also address the conflicts of interest that can arise in Venture Capital Companies and Venture Capital Funds, now covered by the term "Alternative Investment Undertakings". We won't be able to find solutions, but we want this study to act as a guide, as a beacon so that all the boats (decision-making processes of a conflict of interest) reach a good port.
