Gender-based violence is a social and legal issue that has been the subject of debate and discussion around the world. In Portugal, the relationship between gender-based violence and criminal law has evolved over the years, reflecting changes in society and the role of women. This master’s dissertation will address topics such as the historical evolution of the role of women in the law, femicide, obstetric violence, and positive discrimination, focusing on the relevance of specific legislation and its effectiveness in reversing the conditions that motivate violence against women. Through a detailed analysis of the Portuguese criminal law topics, we aim to provide a comprehensive view on those topics and the correlation between them and the issue of gender-based violence in Portugal and the necessary measures to eradicate it.
