Abstract

The following dissertation will deal with the crime of domestic violence in the context of dating relationships. Domestic violence is a widely recognized reality in our society that can’t hidden and unfortunately has already killed some victims. The issue of domestic violence has been a matter of concern both at public and political levels given the proximity of the relationship between the perpetrator and the victim, often in the family and home, where this crime is practiced when it would be expected to be a safe and secure place. We will critically examine article 152, number 1, paragraph b) of the Penal Code in the wording given to it by Law 19/2013, of February 21, which is in force without neglecting a brief historical note of the precept. As we mentioned, we will analyse the crime of domestic violence, in the context of dating relationships, but after all, what is the meaning of "courtship" nowadays? We will try to answer this question based on some sociological considerations, as well as the teachings of the existing Doctrine and Jurisprudence on this subject and review the subject in the light of Comparative Law to present the conclusions we have reached at the end.
