Wrongful birth/life actions e a responsabilidade médica civil em Portugal

Abstract

The study we propose to carry out is based on wrongful actions, more precisely on wrongful birth/life actions and their impact on medical civil liability in Portugal. The interest in this theme comes from the multiplicity of legal obstacles that these types of actions face since their genesis, and from the perplexing moral, ethical and religious conceptions that persecute them. During our study we will reveal the main characteristics of this type of actions, followed by an analysis of the historical evolution of jurisprudence, both internationally and nationally. In the last chapter we will provide a legal framework of wrongful birth/life actions in the portuguese civil liability regime, identifying their requirements, trying to find the best method indicated to fulfill them.
