“Training of national judges in EU competition law - EU COMPETITION LAW ENFORCEMENT BY NATIONAL COURTS is an European project funded by the European Commission, and supported by Centre for the Judicial Studies (CEJ). The aim of the project is to give national judges a detailed knowledge of key issues in competition law (antitrust rules, state aid control and private enforcement and application of antitrust rules to regulated industries) as well as the practical usefulness of those subjects, allowing national judges to correctly apply EU law.
Key Objectives:
This Project aims at to ensure coherent and consistent application of the European Union's Competition rules, namely articles 101 and 102 TFUE, articles 107 and 108 TFUE, and private enforcement rules - by national courts and to promote a competition culture with the continuous implementation of the "Observatory on the Application of Competition Law".
The project aimed to ensure coherent and consistent application, by national courts, of the European competition rules including articles 101 and 102 TFEU (antitrust rules), state aid rules (articles 107 and 108 TFEU) private enforcement, and competition in regulated industries, as well as to improve mutual understanding among national judges and prosecutors of the Member States involved.
Furthermore, it encompassed specific training needs, focusing namely on the role of judges in the application of EU competition law. Advanced training included specific issues related to article 102 – the need for a (economic) test for anticompetitive abuses of dominance and the remedies which should apply in those cases –, private antitrust enforcement – namely the issue of disclosure and quantification of harm – and state aid rules, as well as the application of EU competition rules to regulated industries (namely in the pharmaceutical sector) through workshops and case studies by leading legal practitioners and judges with large experience in competition cases.
The training activities were also led by judges with a large experience in competition cases and also collaborate with the competition law enforcement observatory (https://fd.porto.ucp.pt/pt-pt/observatory-competition-law-enforcement ).
